This policy describes how MSH goes about collecting, using, maintaining, protecting, and disclosing the information that it receives about you from your interaction with any MSH websites, mobile applications, and social media (collectively the “MSH Platform”).  This policy also describes how MSH collects information about subject matter experts from public, third-party sources to create a repository of potential recruits for the purpose of staffing specific projects. Throughout this policy, you will see the terms “I,” “you,” “your,” and “yours” - these terms refer to visitors to and users of our MSH Platform or any of the content contained therein, and to subject-matter experts. 

MSH will comply with all applicable data protection laws as they may vary from time to time, including the General Data Protection Regulation (Regulation (EU) 2016/679) and national implementing legislation, the UK GDPR and the UK Data Protection Act 2018.  For the purposes of applicable data protection laws, MSH is a “Controller”.  This means that MSH is responsible for deciding how we handle and use your Personal Information. MSH is also subject to applicable state and federal laws of the United States.

This policy may be changed at any time, in which case the revised Privacy Policy will apply to information collected after the date it is posted. By accessing the MSH Platform, you agree that you have read and understand the terms and conditions of this Privacy Policy.

MSH has servers located in the United States and is subject to the applicable state and federal laws of the United States. If you choose to access the MSH Platform, you consent to the use and disclosure of information you provide in accordance with this Privacy Policy and subject to such laws, including data protection laws, to the extent applicable.

The MSH Platform is not intended for, and should not be used by, children under 16 years of age. MSH does not knowingly collect Personal Information from children under 16, and in the event that MSH learns that the Personal Information of a child under 16 has been collected or received, it will be deleted.

TYPES OF INFORMATION MSH MAY COLLECT

MSH may collect several types of information from and about users of our MSH Platform (some of which is Personal Information), including:

  • Information you choose to provide by, for example, filling out forms, signing up to our newsletter, creating an account on MSH’s websites or on other components of the MSH Platform, or making a donation (for example, name, email address, postal address, telephone number, company name, job title, gender identity).
  • Information regarding financial transactions, namely donations, made through our website.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Information about your Internet connection, the equipment you use to access components of our MSH Platform, and usage details including:
    • traffic data, location data logs, and other communication data and the resources that you access and use on the MSH Platform.
    • your IP address, operating system, and browser type.

MSH also collects information about individuals with particular subject-matter expertise in order to create a repository of potential recruits for the purposes of staffing projects. Such information may include name, organizational information, LinkedIn profile, CV.

WAYS THAT MSH MAY COLLECT INFORMATION

MSH may collect information (which can include Personal Information) either directly from you the user (for example by filling out forms, signing up to our newsletter, creating an account or making a donation), and/or automatically as you navigate through the MSH Platform. Information collected automatically may include usage details, IP addresses, and information collected through Google Analytics.

 If you choose to make a donation to MSH, whether by telephone, postal mail, or an MSH website, we will collect certain required financial information from you (such as your credit card information if you choose to submit your donation in that manner, and the donation amount).

Online donations are processed by a third-party service provider (see section entitled “To Whom Will MSH Disclose your Personal Information” below) and you should read the section below (and on our Terms of Use) entitled "Links to Other Sites" and familiarize yourself with the privacy terms of all such non-MSH sites before using them. 

Users may provide information to be published or displayed on public areas of the MSH Platform, or transmitted to other users of the MSH Platform. Posting Personal Information on the MSH Platform means that such information is publicly available.  Information posted on and transmitted to others is at your own risk.  We strongly recommend that you do not disclose Personal Information that could be used to identify you.

MSH collects information about subject-matter experts both directly from such individuals (either following a direct approach by such individual or a direct approach to such individual by MSH), or from public, third-party sites such as LinkedIn.

HOW MSH MAY USE THE INFORMATION IT COLLECTS

MSH may use the information that it collects in the following ways:

  • To help MSH present the MSH Platform components and their contents to users.
  • To provide users with information that they request from MSH.
  • To send you communications, including our newsletter.
  • To process your donations.
  • To administer and protect the MSH Platform.
  • To fulfil any other purpose for which the user provided the information.
  • In any other way that is described when a user provides the information.
  • For any other purpose that you have been notified about and, where appropriate, your consent has been obtained.
  • To create a repository of subject-matter experts for the purpose of staffing projects.

The legal basis that MSH will rely upon to use your Personal Information will depend on the circumstances in which it is collected and used.  In most cases, the legal basis will be one of the following:

  • You have provided consent to MSH to use your Personal Information in a particular way.
  • The use of your Personal Information is necessary for the performance of a contract MSH has with you.
  • The use of your Personal Information is necessary for compliance with a legal obligation that MSH has.
  • The use of your Personal Information is necessary for MSH’s legitimate interests, for example, in furthering our mission to save lives and improve the health of the world’s poorest and most vulnerable people.

TO WHOM WILL MSH DISCLOSE YOUR PERSONAL INFORMATION?

MSH will not sell your Personal Information to any third-party organizations.

From time to time MSH may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

MSH may also disclose Personal Information that is collected as described above:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request. We may also share your Personal Information with our legal advisers for the purposes of obtaining and advice and the protection of our legal rights.
  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties who support MSH and its charitable purposes, who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which MSH disclosed it to them. Such organizations include, for example, our website administrators, mailing list administrators (such as Mailchimp), payment platforms (such as Click & Pledge).
  • To fulfill the purpose for which the user provided it.
  • For any other purpose disclosed by MSH when the user provided the information.
  • With the user’s consent.

Your Personal Information may be transferred and stored outside the EU or the UK.  For example, MSH has servers located in the United States.  MSH will have adequate safeguards in place to ensure the security of your Personal Information when it is transferred and stored outside the EU or the UK, including, for example, standard contractual clauses. FOR HOW LONG MSH WILL KEEP YOUR PERSONAL INFORMATION

MSH will keep your Personal Information only for so long as is necessary to fulfil the purposes for which we collected it, and/or for as long as is necessary for the legitimate purposes of our legal rights and obligations. For example, this may mean that we delete your data if you unsubscribe from our newsletter, or similar. After such time, we will delete your Personal Information from our systems and require that anyone to whom we have transferred your Personal Information also delete it.

USE OF COOKIES

Some elements of the MSH Platform use “cookies” which are small pieces of data that are sent to your browser from MSH’s web server and stored on your computer's hard drive for the purpose of collecting information about you as a user, such as Web surfing behavior or user preferences for a specific website.

The MSH Platform uses both session cookies and persistent cookies. Session cookies are automatically removed from your device when you close your browser.  Persistent cookies remain on your device until the expiry date specified in the cookie is reached.

The MHS Platform uses both first party cookies and third party cookies.  First party cookies are cookies that are put on your device directly by the website provider and are used to recognize your device when it revisits a site and to remember your preferences as you browse the site.  Third party cookies are served by a service provider on behalf of the website operator and are commonly used for website analytics or advertising purposes.

Most browsers also allow you to view websites in “private mode”, which deletes cookies after you visit the site. You can still visit the MSH Platform if your browser is in “private mode”, but the user experience may not be optimal and some functions may not work.

If you want to remove previously stored cookies, you can manually delete cookies at any time. This will not prevent the MSH Platform from placing further cookies on your device, however, unless and until you adjust your browser settings as described above.

HOW MSH PROTECTS PERSONAL INFORMATION

MSH uses reasonable security precautions to protect the security and integrity of user’s Personal Information in accordance with this Privacy Policy and applicable law.

MSH encrypts transmissions of personal information through our websites using secure socket layer technology (SSL) but cannot guarantee the security of Personal Information transmitted to the MSH Platform.

Where MSH has given you (or you have chosen) a password that enables you to access certain parts of the MSH Platform, you are responsible for keeping this password confidential.  We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of Personal Information transmitted to our websites or other MSH Platform components. Any transmission of Personal Information is at your own risk.  Without limitation of the foregoing, we are not responsible for the actions of hackers and other unauthorized third parties that breach our reasonable security procedures.

LINKS TO OTHER SITES

The MSH Platform includes links to sites not owned or managed by us.  Clicking on those links may allow third parties to collect or share information about you.  MSH cannot be held responsible for the privacy of information collected by websites not managed by us.  When you leave the MSH Platform, we encourage you to read the privacy policy of every website you visit.

HOW USERS CAN ACCESS AND CORRECT PERSONAL INFORMATION

Users can review and change any of the Personal Information they provided when registering for an account on the MSH Platform by logging into the appropriate website and visiting their account profile page.

If a user deletes his/her contributions from the MSH Platform, copies may remain viewable in cached and archived pages, or might have been copied or stored by other website users. 

RIGHTS THAT UK OR EU RESIDENTS HAVE

If you are resident in the UK or the EU, you have a number of rights relating to your Personal Information.  These include the right to:

  • Access a copy of the Personal Information MSH holds about you.
  • Rectify inaccuracies in the Personal Information MSH holds about you.
  • In certain circumstances, have the Personal Information MSH holds about you deleted.
  • In certain circumstances, restrict the use of your Personal Information.
  • In certain circumstances, object to the use of your Personal Information.
  • In certain circumstances, transfer the Personal Information MSH holds about you to another entity.
  • Withdraw any consent you have provided for the use of your Personal Information.
